2月に施行された土壌汚染対策法とともに、不動産関連の2つの法律（宅地建物取引業法と不動産鑑定評価基準）が改正され、不動産の価値や取引における土壌汚染による影響が懸念されている。浄化責任追及の裁判や汚染サイトの流動化などにより問題が長期化した米国では、法律改正や政策的取り組みを経て、現在では汚染サイトの浄化のメドが立ちつつある。土壌汚染をより早くかつ効率的に浄化し、人体や自然環境への悪影響を防止するとともに、停滞している国内不動産市場において土壌汚染問題の影響を最小限にすることが望まれる。米国の20年にわたる法制度の変換をもとに今後国内で望まれる政策の方向性を考察したい。
